Pension of Pre-2006 Hony Nb Sub โ Judgment in OA 1816/2018 filed in the Armed Forces Tribunal (AFT), Principal Bench, New Delhi dated 06.02.2025.

Dear Sir,
TSEWA has won the legal case OA 1816/2018 filed in the Armed Forces Tribunal (AFT), Principal Bench, New Delhi, to get pension of Naib Subedar to Pre-2006 Honorary Naib Subedars. A copy of the judgment is attached.
All the petitioners are now required to approach their respective Record Offices (RO) with a copy of ibid judgment and request the RO to approach Army Headquarters to take necessary action to get arrears, which is the difference in pension of Naib Subedar and Honorary Naib Subedar.
Please do not approach HQ TSEWA, as our task ends with getting the judgment. Thereafter, the petitioners is required to approach their respective Record Offices to get arrears.

Sir, Prior 01 Jan 2006 there was no ACP/MACP in Armed force except in civil but after 01 Jan 2006 and 2016 the Said ACP/MACP came into an introduced. Post2006 and 2016 retirees are getting equal pension od next higher rank to which they got ACP/MACP but pre-2006 retirees are not covered by the scheme. For example you can see the pension of ACP/MACP Nb sub and Hony Nb Sub in Cir No 555, 666 and Cir 667 besides Cir No 566, 578, 634 respectively.
Sir, An Havildar passed JCO cadre become Nb Sub then Sub then Sub Maj as per seniority but those become Hony Lt or Hony Capt not passed any examination any an academy except CHAMCHAGIRI while in an active list of service period just before 2 to 6 months of his retirement on age/service limit and treated/equated with regular commissioned officers rank of Lt and Capt at pay level 10B whereas an Havildar and Havildar/Clerk who having in possessions of Graduate and passed same cadre of JCO kept in the list of after retirement and stating everywhere as he never served in rank of regular Nb Sub why? If a Chamcha JCO can get the benefit of Hony Commission of Lt and Capt rank from JCO rank without passing any examination! why not an Havildar who passed the JCO cadre get the benefit of in an active list even after fulfilled all the criteria upto Sub Maj rank? this is the partial modification to depriving method of a capable Havildar/Clerk. 2ndly there is also a great insult between the rank of Hony Nb Sub of X Gp and Y Gp. Service pension of a X Gp Hony Nb Sub is equated with regular Nb Sub but Y Gp Hony Nb Sub is kept in below and low than the regular Nb Sub. Sir, Rule must be applicable same but why the separate method is applied/exposed to Y Gp. I request to analyze the anomaly envisaged in Cir No 555, 666 and 677 for pre-2006 Hony Nb Sub specially to those who had passed the JCO cadre and examinations while in active list of service and solve the anomaly in ensuing 8th CPC which is under constituted.
