COMMENTS
I fully agree with the views expressed by Mr.Vasave regarding implementation of the CAG,s orders on grant of notional increment restricting the benefit to those only who have retired or shall be retiring after 11.04.2023 but it was not the intent of hon,ble Supreme Court orders as all the petitioners involved in court cases & allowed the benefit pertained to the period from 30.06.2006 onwards & the Supreme Court allowed the benefit accordingly. Therefore, CAG,s orders dated 18.01.2024 restricting benefit aligning with the Apex court verdict date is not fair rather confusing because in case of petitioners the order was made effective retrospectively whereas in case of non petitioners it was made prospectively which violates the principles of natural justice & equality as enshrined in Article 14 of Constitution of India.
