Sub : Transfer of employees who are Office bearers of recognized Trade Unions.

Railway Board have circulated instructions to be followed while transferring the railway employees who are office bearers of recognized trade unions, vide Itr. No. E(LR)III/79/UTF/14, dated 16.01.1980 and the same reiterated vide RBE No. 48/2012 (S.C. No. 46/2012).
As per these instructions, inter alia, any proposal to transfer an office bearer of a recognized trade union including its branches thereof should be advised to the union concerned and the union allowed to bring to the notice of the Divisional Officer and if necessary, later to the General Manager any objection that they may have to the proposed transfer. If there is no agreement at the lower levels the decision of the General Manager will be final. Sufficient notice should be given to the union of a proposed transfer to enable the Union to make alternative arrangements for carrying on the work or for making a representation against the proposed transfer.
Of late it has come to the notice that the office bearers are being transferred without prior intimation to the trade union concerned, leading to representations from the trade unions. The officers who are signing the Office Order inter alia should ensure that appropriate procedure has been followed where transfer of office bearers is involved.
It is therefore, advised to adhere to the instructions contained in the above said Railway Board’s letter, whenever there is a proposal to transfer office bearers of trade unions.
These instructions may be brought to the notice of all concerned.
