533. सुश्री मिमी चक्रवर्ती:
क्या कोयलो मंत्री यह बताने की कृपा करेंगे कि:

(क) कया सरकार के पास गत तीन वर्षों में देश में कोयला खनन के दौरान मारे गए और घायल हुए खान श्रमिकों की संख्या का कोई आंकड़ा है;

(ख) यदि हां, तो गत तीन वर्षों का राज्य-वार और वर्ष-वार ब्यौरा क्‍या है;

(ग) क्‍या सरकार ने मृतक श्रमिक के परिवार को किसी प्रकार का मुआवजा प्रदान किया है; और

(घ) यदि हां, तो तत्संबंधी ब्यौरा क्या है और यदि नहीं, तो इसके क्या कारण हैं?

(क) और (ख) : पिछले तीन वर्षों में देश में कोयला खनन के दौरान मारे गए और घायल हुए खान श्रमिकों की संख्या का विवरण अनुबंध में दिया गया है।

(ग) और (घ) : जी, हां। मृतक कामगार के निकटतम संबंधी को कर्मचारी मुआवजा अधिनियम-1923 (आज की तारीख तक संशोधित मूल अधिनियम) के अनुसार मुआवजे का भुगतान किया जाता है। रोजगार से और इसके दौरान किसी भी खान दुर्घटना में मारे गए मृतक के परिवार को कोल इंडिया लिमिटेड (सीआईएल) और सिंगरेनी कोलियरीज कंपनी लिमिटेड (एससीसीएल) द्वारा निम्नलिखित मुआवजा और अन्य वित्तीय राहत आदि प्रदान की जाती है:

विभागीय कर्मचारी के मामले में –

1. कर्मचारी मुआवजा अधिनियम 1923 के तहत मुआवजे का भुगतान (पिछली बार अधिसूचना एस.ओ. 71 (ई/ दिनांक ३ जनवरी, 2020 के माध्यम से संशोधित।

2. खान दुर्घटना के कारण मारे गए विभागीय कर्मचारी के आश्रित को रोजगार दिया जाता है। यदि रोजगार के लिए कोई पात्र व्यक्ति नहीं है, तो मृतक के परिवार को रोजगार के बदले प्रति माह आर्थिक मुआवजा दिया जाता है।

३. मृतक विभागीय कर्मचारी के आश्रित को विशेष राहत / अनुग्रह राशि के रूप में 15 लाख रु. का भुगतान किया जाता है, जो कर्मचारी मुआवजा अधिनियम-1923 (2020 तक संशोधित) के तहत देय राशि के अतिरिक्त है। (दिनांक 14.11.2019 के कार्यालय आदेश के माध्यम से राशि में संशोधन किया गया)।

4 अंतिम संस्कार, परिवहन खर्च आदि के लिए मृतक के परिवार को एकमुश्त राशि (सामान्यतः: 20,000 रुपए) का तत्काल भुगतान।

5. एनसीडब्ल्यूए-एक्स के अनुसार 1.10.2017 से लाइफ कवर स्कीम (एलसीएस) के तहत 1,25,000/- रुपए का वित्तीय लाभ।

6. एनसीडब्ल्यूए-एक्स के अनुसार 01.10.2017 से रोजगार से और इसके दौरान हुई दुर्घटना के कारण मृत्यु होने या स्थायी रूप से पूर्ण विकलांगता के मामले में 90,000/- रुपए की अनुग्रह राशि।

7. उपदान संदाय अधिनियम, 1972 के अनुसार सेवा की अवधि के आधार पर उपदान।

8. अन्य लाभ जैसे सीएमपीएफ नियम के अनुसार पीएफ, सीएमपीएस, 1998 के अनुसार पेंशन, कंपनी (सीआईएल) नियमों के अनुसार ईएल का नकदीकरण आदि।

संविदा कर्मचारी के मामले में –

1. कर्मचारी मुआवजा अधिनियम 1923 के तहत मुआवजे का भुगतान (पिछली बार अधिसूचना एस.ओ. 71 (ई) दिनांक 3 जनवरी, 2020 के माध्यम से संशोधित)।

2. मृतक विभागीय कर्मचारी के आश्रित को विशेष राहत / अनुग्रह राशि के रूप में 15 लाख रु. का भुगतान किया जाता है, जो कर्मचारी मुआवजा अधिनियम-1923 (2020 तक संशोधित) के तहत देय राशि के अतिरिक्त है। (दिनांक 14.11.2019 के कार्यालय आदेश के माध्यम से राशि में संशोधन किया गया)।

3. सेवा की अवधि के आधार पर उपदान।

4. सीएमपीएफ/ईपीएफ नियम के अनुसार पीएफ जैसे अन्य लाभ।

Compensation to Coal Mine Workers

533. MS. MIMI CHAKRABORTY:

Will the Minister of COAL be pleased to state:

(a) whether the Government has any data on the number of mine workers died and injured during coal mining across the country during the last three years;

(b) if so, the details for the last three years, State and year-wise;

(c) whether the Government has provided any kind of compensation to the family of deceased worker; and

(d) if so, the details thereof and if not, the reasons therefor?

ANSWER

MINISTER OF PARLIAMENTARY AFFAIRS, COAL AND MINES (SHRI PRALHAD JOSHI)

(a)&(b): The details of number of mine workers died and injured during coal mining in the country in last three years is annexed.

(c)&(d): Yes Madam. Compensation is paid as per the Employees Compensation Act-1923 (Principal Act upto amended as on date) to the next of kin of the deceased worker. Coal India Ltd. (CIL) and Singareni Collieries Company Ltd. (SCCL) are provides the following compensation and other monetary relief etc. to the family of deceased who died in any mine accident arising out of and in course of employment.

In case of Departmental Employee –

1. Payment of compensation under the Employee’s Compensation Act 1923 (last amended vide notification S.O. 71 (E) dated January 3, 2020).

2. Employment is offered to the dependent of deceased departmental employee due to mine accident. In case there is no eligible person for employment, monetary compensation per month is paid to the family of the deceased in lieu of employment.

3. Rs. 15 lakhs is paid to the dependent of deceased departmental employee as a special relief / ex-gratia, which is in addition to the amount payable under the Employee’s Compensation Act-1923 (amended upto 2020). (Amount revised vide Office Order dt 14.11.2019)

4. Immediate payment of lump sum amount (generally Rs 20,000) to the family of deceased for funeral, transport expenses etc.

5. Monetary benefits under Life Cover Scheme (LCS) of Rs 1,25,000/ w.e.f. 1.10.2017 as per NCWA-X.

6. Ex-gratia amount of Rs 90,000/ in case of death or permanent total disablement resulting on account of accident arising out of and in course of employment w.e.f 01.10.2017 as per NCWA-X.

7. Gratuity on the basis of the length of service as per the Payment of Gratuity Act, 1972.

8. Other benefits like P.F as per CMPF rule, Pension as per CMPS, 1998, Encashment of EL etc. as per company (CIL) rules.

In case of contractual Employee –

1. Payment of compensation under the Employee’s Compensation Act 1923 (last amended vide notification S.O. 71 (E) dated January 3, 2020).

2. Rs. 15 lakhs is paid to the dependent of deceased departmental employee as a special relief / ex-gratia, which is in addition to the amount payable under the Employee’s Compensation Act-1923 (amended upto 2020). (Amount revised vide Office Order dt 14.11.2019)

3. Gratuity on the basis of the length of service.

4. Other benefits like P.F as per CMPF / EPF rule.
