Deputy Legal Advisors Recruitment Rules 2020 in the Department of Food Safety, Govt. of National Capital Territory of Delhi

Br/4242-4248.-In exercise of powers conferred by the proviso to Article 309 of the Constitution, read with the Govt. of India, Ministry of Home Affairs notification No. F.24/78/68- DH(S) dated 24th September, 1968, and in supersession of the Recruitment Rules to the post of Deputy Legal Advisor vide notification No. F.2(47)/78-S-II/ dated 29th November, 1980, published in the Delhi Gazette Part-IV except as respects things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi, hereby makes the following rules to the post of “Deputy Legal Advisor” in the Department of Food Safety, Govt. of National Capital Territory of Delhi.
- Short title and commencement- (i) These rules may be called “Department of Food Safety, Deputy Legal Advisors Recruitment Rules, 2020.
(ii) They shall come into force on the date of their publication in the Delhi Gazette.
- Number of post, its classification and Level in the Pay Matrix/Scale of pay– The number of said posts, their classification and Level of Pay Matrix/scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
- Method of recruitment, age limit, qualification – The method of recruitment, age limit, qualification and other matters relating to the said post, shall be specified in the columns (5) to (13) of the said Schedule.
- Disqualifications :- No person-
- who has entered into or contracted a marriage with a person having a spouse living; or
- who, having a spouse living, has entered into or contracted a marriage with any person; shall be eligible for appointment to the said post:-
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing, exempt any person from the operation of this rule.
- Powers to relax- Where the Government is opinion that necessary or expedient so to do, it may, by order for reasons to be recorded in the writing, relax and of the provision of these rules with the respect to any class or category of persons.

ESSENTIAL:
(I) Degree of Law from a recognized university. (II) EXPERIENCE Five years experience in legal work for Department of Central Government /State Governments/ UTs/PSU/ Autonomous or Statutory Bodies/ recognized institutes/ recognized universities , OR listed companies OR Law firm OR as a legal practitioners (Ill) DESIRABLE (i) LLM from a recognized university. (iii) Head of Department, unless he/she is ex-officio secretary in the Department , Government of National Capital Territory of Delhi |
Consultation with Union Public Service Commission is necessary on each occasion. |

(A)(II) With five years service in the grade rendered after appointment thereto on regular basis in Level – 9 (Rs. 53, 100- 1,67,800) I Level-10 (Rs. 56100-177500) or equivalent in the parent cadre or department AND (B) Possessing the educational qualification and experience as prescribed for direct recruitment under Column . (7). The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/ department of the Central Government shall ordinarily not exceed four years. The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of applications |
