Petroleum and Natural Gas Regulatory Board (Salary, Allowances and Other Conditions of Service of Officers and Employees) Rules, 2020

NOTIFICATION
New Delhi, the 21st September, 2020
G.S.R. 612(E).—In exercise of the powers conferred by sections 10 and 60 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Central Government hereby makes the following rules, namely:-
CHAPTER – I
PRELIMINARY
1. Short title and commencement.- (1) These rules may be called the Petroleum and Natural Gas Regulatory Board (Salary, Allowances and Other Conditions of Service of Officers and Employees) Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.– These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules:
Provided that these rules shall not apply to the officers and other employees of the Board, who, at the time of commencement of these rules, are holding their respective posts either on deputation or on short-term contract basis.
3. Definitions.– (1) In these rules, unless the context otherwise requires,-
(a) “Act” means the Petroleum and Natural Gas Regulatory Act, 2006 (19 of 2006);
(b) “Appointing Authority” means-
(i) Chairperson, in respect of all posts equivalent to Group ‘A’ posts under the Central Government, recruitment to which are made directly by the Petroleum and Natural Gas Regulatory Board;
(ii) Secretary, in respect of all posts equivalent to Group ‘B’ and Group ‘C’ posts under the Central Government, recruitment to which are made directly by Petroleum and Natural Gas Regulatory Board;
(c) “Disciplinary Authority” means-
(i) Chairperson, in respect of the posts equivalent to Group ‘A’ specified in serial numbers 1 to 5 in column (1) of the Schedule annexed to these rules:
Provided that in respect of officers on deputation from the Central Government or any State Government or Public Sector Undertaking or autonomous or statutory organisations, the relevant rules or regulations applicable to such categories of employees in their parental organisation shall apply;
(ii) Secretary, in respect of the posts specified in serial numbers 6 to 12 in column (1) of the Schedule annexed to these rules;
Provided that in respect of officers on deputation from the Central Government or any State Government or Private Sector Undertaking or autonomous or statutory organisations, the relevant rules or regulations applicable to such categories of employees in their parental organisation shall apply;
(d) “registered medical practitioner” means a medical practitioner who possess any recognised medical qualification as defined in clause (h) of section 2 of the Indian Medical Council Act, 1956 (102 of 1956) and whose name has been entered in a State Medical Register;
(e) “Schedule” means the Schedule annexed to these rules;
(f) “staff” includes both officers and employees of all categories appointed in the Board whether on whole time basis, on deputation on foreign service terms or permanent absorption or on short term contract basis;
(g) “short term contract basis” means the method of recruitment of persons belonging to non-Governmental organisations from private sector to the Board for a limited period on contract basis.
(2) Words and expressions used in these rules and not defined but defined in the Act, shall have the same meanings as respectively assigned to them under the Act.
CHAPTER – II
SANCTIONED STRENGTH
4. Sanctioned strength of staff of Board – (1) The sanctioned strength of the staff in the Board shall be as approved by the Central Government under sub-section (2) of section 10 of the Act, in different pay scales.
(2) The number of posts, their classification and the level in pay matrix or pay scale attached thereto shall be as specified in the Schedule.
5. Recruitment and appointment.- (1) Appointments against the sanctioned posts in the Board shall be made on deputation basis.
(2) The term of deputation shall be initially for a period of three years, which may be extended for successive terms of one year each for a maximum of two years, at the discretion of the Board in accordance with the general guidelines issued by the Central Government:
Provided that in case the Board comes to a conclusion that the services of any deputationist are no longer required with the Board, such deputationist may be repatriated to his parent Department or organisation even before the completion of his deputation period.
(3) The appointment against the sanctioned posts on contract basis shall be made initially for a period of one year extendable by another two years, one year at a time at the discretion of the Board:
Provided that in case the Board comes to a conclusion that the services of any person on contract are no longer required with the Board, his contract period may be terminated or curtailed at any time without assigning any reason.
