NOTIFICATION

New Delhi, the 28th September, 2020

G.S.R. 607(E).—In exercise of the power conferred by clause (j) of sub-section (2) of section 56 of the Energy Conservation Act, 2001 (52 of 2001), and in supersession of the Energy Conservation (Minimum Qualification for Energy Managers) Rules, 2006, Except as respects things done or omitted to be done before such supersession, the Central Government, in consultation with the Bureau of Energy Efficiency hereby makes the following rules to prescribe minimum qualifications for Energy Auditors and Energy Managers under clause (m) of section 14 of the said Act, namely:-

1. Short Title and Commencement.- (1) These rules may be called the Energy Conservation (Minimum Qualification for Energy Auditors, Energy Auditors (Building) and Energy Managers) Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these rules, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001 (52 of 2001);

(b) “agency” means an agency appointed by the Bureau for holding National Examination for certification of Energy Auditors, Energy Managers, or Energy Auditors (Building);

(c) “certificate” means the certificate issued, on being declared successful in the National Examination, by the Bureau or the agency notified by the Bureau in support of Energy Auditor or Energy Auditor(Building) or Energy Manager;

(d) “Diploma Engineer” means a person who has obtained a diploma in engineering from any institution recognised by the All India Council for Technical Education under the All Indian Council for Technical Education Act, 1987 (52 of 1987);

(e) “Graduate Engineer” means a person who has obtained a graduation degree in engineering from a University or a deemed to be University declared under the provisions of the University Grants Commission Act, 1956 (3 of 1956) or its equivalent recognised by the All India Council for Technical Education under the All Indian Council for Technical Education Act, 1987 (52 of 1987);

(f) “Graduate Architect” means a person who has obtained a graduation degree in architecture from a University or a deemed to be University declared under the provisions of the University Grants Commission Act, 1956 or its equivalent, recognised by the All India Council for Technical Education under the All Indian Council for Technical Education Act, 1987 (3 of 1956);

(g) “National Examination” means the examination conducted by the Bureau or the agency appointed by the Bureau for certification of Energy Auditors and Energy Managers or Energy Auditors (Building);

(h) “Post- Graduate in Engineering” means a person who has obtained a post-graduation degree in engineering from a University or a deemed to be University declared under the provisions of the University Grants Commission Act, 1956 or its equivalent, recognised by the All India Council for Technical Education under the All Indian Council for Technical Education Act, 1987;

(i) “Post- Graduate in Architecture” means a person who has obtained a post-graduation degree in architecture from a University or a deemed to be University declared under the provisions of the University Grants Commission Act, 1956 or its equivalent, recognised by the All India Council for Technical Education under the All Indian Council for Technical Education Act, 1987;

(j) “Post- Graduate” means a post-graduate degree or its equivalent, recognised by University or a deemed to be University under the provisions of the University Grants Commission Act, 1956;

(2) Words and expressions used in these rules and not defined, but defined in the Act, shall have the meaning respectively assigned to them in the Act.

3. Qualification for a person to be recognised as certified Energy Auditor or Energy Auditor (Building) or Energy Manager.– A person shall be qualified to become a certified Energy Auditor or Certified Energy Auditor (Building) or certified Energy Manager, if he has passed the National Examination for Energy Auditor or Energy Auditor (Building)or Energy Manager, and has been issued a certificate in accordance with the provisions of the Bureau of Energy Efficiency (Certification Procedure for Energy Auditor, Energy Auditor (Building) and Energy Manager) Regulations, 2020 by the Bureau to that effect.

4. Minimum Qualification for appearing in the National Examination for the certification of Energy Auditor or Energy Auditor (Building) or Energy Manager.– (1) A person shall be eligible for appearing in the National Examination for the certification of Energy Auditor or Energy Auditor (Building), if he is,-

(a) a Graduate Engineer or Graduate Architect with three years of work experience involving use of energy in operation, maintenance, planning, energy management, energy efficiency and energy conservation, building design or building energy management; or

(b) a Post-Graduate in Engineering or Architecture with two years of work experience involving use of energy in operation, maintenance, planning, energy management, energy efficiency and energy conservation, building design or building energy management; or

(c) a Graduate Engineer or Graduate Architect with a post-graduate degree in Management or its equivalent with two years of work experience involving use of energy in operation, maintenance, planning, energy efficiency and energy conservation, building design or building energy management.

(2) A person shall be eligible for appearing in the National Examination for the certification of Energy Manager, if he,-

(a) fulfils eligibility criteria specified in sub-rule (1) or

(b) is a Diploma Engineer with six years of work experience involving use of energy in operation, maintenance, planning, energy management, energy efficiency and energy conservation, building design or building energy management; or

(c) is a Post-Graduate in Physics or Electronics or Chemistry (with Physics and Mathematics at graduation level) with three years of work experience involving use of energy in operation, maintenance, planning, energy management, energy efficiency and energy conservation, building design or building energy management.

(3) A candidate appearing in the National Examination shall be eligible for award of certificate on being declared successful in the said examination.

(4) Any National Examination for certification of Energy Managers or Energy Auditors held by the Bureau prior to the notification of these rules shall be deemed to have been conducted under these rules.
