Subject: Modified Assured Career Progression Scheme (MACPS) for PBOR of
Army.
Sir,
Consequent upon the judgement of Hon’ble Supreme Court dated 08-12-2017, in
the matter of Civil Appeal Diary No.3744 of 2016 (UOI Vs Shri Balbir Singh
Turn & Anr), I am directed to refer to this Ministry’s letter No.
14(1)/99-D(AG) dated 30 May 2011 on the above subject and to state that the
President is pleased to make the following amendment in para 5 of the
aforesaid letter:
the matter of Civil Appeal Diary No.3744 of 2016 (UOI Vs Shri Balbir Singh
Turn & Anr), I am directed to refer to this Ministry’s letter No.
14(1)/99-D(AG) dated 30 May 2011 on the above subject and to state that the
President is pleased to make the following amendment in para 5 of the
aforesaid letter:
FOR : “The scheme would be operational w.e.f. 01 Sep 2008”
READ: “The scheme would be operational w.e.f. 01 Jan 2006”
2. The other terms and conditions (including eligibility), as mentioned in
the MoD letter No. 14(1)/99-D(AG) dated 30 May 2011 would continue to
remain the same.

3. This issues with the concurrence of the Ministry of Defence (Finance)

COMMENTS
I was enrolled in army on 20 April 1978 and retired on 01-05-2006 after completion of 30 yrs and 10 days of service in the rank of subedar. I completed 30 yrs of service on 20-04-2006 and thus due for macp 3rd as per ruling of 10-20-30 yrs service completion but I was not given any financial upgradation
Sir I retired from army rank of Nk(Hony hav)on 30/6/2008 with grade pay 2400.as per mod order will I eligible for 2 nd financial upgradation MACP scheme.
I am retired on 31.3. 2013 as Hav (Hony Nb Sub) after completion of 24 years of service. I was promoted as Hav wef 1.1.1997 and grant of MACP wef 1.1.2008. May I eligible for the MACP wef 1.1.2006 as per latest policy. please advice me.
The latest order of Ministry of Finance along with comments of the nodal dept.Dopt .dated 9th January 2019 on MACP scheme is very disappointing to those who were deprived of the benefit & waiting for justice on the basis of hon,ble Supreme Court judgement of Dec.2017 & Mumbai High court judgement of Oct. 2018. The arguments put forth by the nodal agency were not found tenable by the Supreme Court & as such orders were passed against Union of India in the matter. To repeat the for further denial does not seem justified.
Sir i Hoshiar Singh EX INDIAN Navy retired from the service on 30 Jun 2008. I was promoted to CPOR(SPL) 01 Feb 1996. on completion of 12 yrs and five months as CPORSPL, and not four months(12 Yrs 05 Months). as per 5th and 6th CPC. Understand that GOI/MoD letter NO. RP/3312/PAY COM/78/US(MP)D(N-II)11 dated 19 May 11. MACP was effected WEF 01 SEP 2008 in Indian Navy. So Kindly pls refer the Hon the President Of India's recommendation not addressed to all Chief of Armed Forces. I am eligible for next promotion and all financial benefits WEF 01 Feb 2004. so ple reconsider my case at the earliest.
It is started from 1/9/2008 on completion of every 10th year upgraded basis pay is to be given in terms of VERY GOOD BENCH MARK only.
Sir I Tribhuvan Vir Vikram Singh EX INDIAN Navy retired from the service on 30 Jun 2008. I was promoted to CPOR(TAC) 01 Nov 1997. on completion of 10 years and eifht months holding as CPOR TAC, and (10 Yrs 08 Months). as per 5th and 6th CPC. Understand that GOI/MOD letter NO. RP/3312/PAY COM/78/US(MP)D(N-II)11 dated 19 May 11. MACP was effected WEF 01 Jan 2006 as per Hon suprime court (letter enclosed)refer. So ple reconsider my case at the earliest.

I took voluntary retirement on completion of 20 years of service on 31 January 2008. Am I eligible for the MACP. … Please clarify
