Dear Sir,

Sub:- Revision of pension of pre-2006 pensioners — delinking of revised pension from qualifying service of 33 years – Request for clarification Reg. Retirement after 10 years of service on Superannuation and absorption in government autonomous bodies / government undertakings

Reference: DOP&PW OM No.38/37/08-P&PW (A) Dated 6-4-2016

1. In reference to DOP&PW / GOI orders cited above Reg. Delinking of revised pension from qualifying service of 33 years of Pre-2006 pensioners, we request you to please clarify the said orders in respect of the applicability of the said orders in case of superannuation and retirement on absorption in government body/ government undertaking and for those who retired from the Central Government service on or before 31.12.2005, after completing 10 years or more of qualifying service – as per orders of CAT New Delhi cited below.
2. Orders of CAT (PB) New Delhi Dated 22-1-2016 in RA 165/2015 in OA 2165-2011 with RA 172/2015 in OA 1165-2011 read as under:
“12. Thus, we allow the RAs directing that in para 13, after the words “would apply both as regards pension and family pension” and before the last sentence, the following sentence shall be added:
“For parity of reasons, the qualifying service for earning pension in case of superannuation and retirement on absorption in government body/ government undertaking will be treated as 10 years also for those who retired from the Central Government service on or before 31.12.2005 and were alive on that date.”
3. The ambiguity persists among the PSAs (Pension Sanctioning Authorities) at all levels – causing further hardship to the Pensioners.
4. It is, therefore, requested to please issue clarification about the application of the provisions of DOP&PW OM dated 6-4-2016 in respect of the following cases also as provided for in CAT (PB) New Delhi Orders dated 22-1-2016 cited above:
“the qualifying service for earning pension (and Family Pension) in case of superannuation and retirement on absorption in government body/ government undertaking will be treated as 10 years also for those who retired from the Central Government service on or before 31.12.2005 and were alive on that date.”

    Sir my pension was RS 23394/-. I am retired BSF NK/OR GET MY PENSION THROUGH SBI DARJEELING A/C 10833328418.THIS MONTH I RECEIVED ONLY RS 7360/-.I HAVE NO OTHER OPTION OTHER THEN SUICIDE .MY FIST WIFE DIED OF CANCER NOW MY WIFE AND SCHOOL GOING DAUGHTER THERE IS NO WAY FOR US .I DO NOT KNOW WHATS THE GOVT DOING

    Military Service Pension be granted to all those non-pensioner Ex-Servicemen who completed a full tenure of three years in any one of the Theater of 1962 – 1965 – 1071 wars and discharged.
