STATEMENT IN RESPECT OF PARTS (a) TO (c) OF RAJYA SABHA STARRED QUESTION NO. 255 FOR 29.8.2012 REGARDING EXTENDING DEMOCRATIC RIGHTS AND FREEDOM TO DEFENCE PERSONNEL.

There is a strong redressal mechanism existing in the Army which deals with all the cases of discontent. Service personnel can seek redressal of their grievances under relevant provisions of Army Act / Defence Services Regulations. Besides, there is an institutionalized feedback mechanism of commanders at all levels by means of frequent interaction between officers and men during work and regular Sainik Sammelans.

2. All democratic rights and freedom are extended to all ranks of the Army subject to the provisions of Army Act. There is no master-servant relationship of colonial days prevalent in the Army. The relationship is based on soldierly ethos embedded in ‘leader’ and ‘led values’ as comrades in arms. Certain strict measures, however, are essential in the interest of discipline and also due to peculiar service conditions in army.

(a) whether Government will adopt effective measures to ensure that the type of discontent expressed by a section of army men against their immediate superiors is not repeated;

(b) whether Government will ensure that soldiers in the lower rungs of the army are extended democratic rights and freedom while maintaining discipline that is essential in defence forces; and

(c) whether Government will ensure that vestiges of master-servant relationship of the colonial days are done away with completely?

क्या रक्षा मंत्री यह बताने की कृपा करेंगे किः

(क) क्या सरकार यह सुनिश्चित करने के लिए कुछ ऐसे प्रभावी उपाय करेगी कि सैनिकों के एक वर्ग द्वारा अपने निकटतम वरिष्ठ अधिकारियों के विरूद्ध जिस प्रकार का असंतोष व्यक्त किया गया है वैसा दुबारा न हो;

(ख) क्या सरकार यह सुनिश्चित करेगी कि रक्षा बलों में अनिवार्य अनुशासन को बनाए रखते हुए सेना के निचले पदों के जवानों को प्रजातांत्रिक अधिकार तथा स्वतंत्रता दी जाए; और

(ग) क्या सरकार यह सुनिश्चित करेगी कि औपनिवेशिक काल के मालिक-नौकर संबंध के चिन्हों को पूर्णतः समाप्त कर दिया जाए ?

रक्षा कर्मियों को प्रजातांत्रिक अधिकार तथा स्वतंत्रता दिए जाने के बारे में राज्य सभा में 29 अगस्त, 2012 को उत्तर दिए जाने के लिए तारांकित प्रश्न सं. 255 के भाग (क) से (ग) के उत्तर में उल्लिखित विवरण-पत्र

सेना में एक सुदृढ़ समाधान कार्यतंत्र विद्यमान है जो असंतोष के सभी मामलों को देखता है । सैन्य कार्मिक, सेना अधिनियम/रक्षा सेवा विनियमावली के संगत प्रावधानों के अंतर्गत अपनी शिकायतों का समाधान करवा सकते हैं । इसके अलावा, कार्य तथा नियमित सैनिक सम्मेलनों के दौरान अफसरों तथा कर्मियों के बीच लगातार विचार-विनिमय के माध्यम से सभी स्तरों पर कमांडरों का एक संस्थागत फीडबैक तंत्र है ।

2. सेना के सभी रैंकों को सेना अधिनियम के उपबंधों के अध्यधीन सभी लोकतांत्रिक अधिकार तथा आजादी दी गई है । सेना में औपनिवेशिक समय का कोई स्वामी-नौकर संबंध प्रचलित नहीं है । सेना में यह संबंध ‘नायक’ और उसके आदेश का पालन करने वाले युद्ध के संगी-साथियों के सैनिक मूल्यों पर आधारित हैं । तथापि, अनुशासन के हित में तथा सेना की विशिष्ट सेवा परिस्थितियों के कारण कुछ कड़े उपाय किए जाने आवश्यक हैं ।
