Through their lawyer Ashok Agarwal, the teachers alleged that the schools had failed to pay them the increased salaries and had dithered over implementing the pay commission recommendations. HC will hear the case again on February 13.
The schools are obliged to give to their employees pay, emoluments and other benefits as per the recommendations from January 1, 2006, and also to pay to them arrears of salary from then till date, argued Agrawal. “The failure to do so is illegal, discriminatory, violative of Articles 14, 16, 21 and 38 of the Constitution of India and contrary to Section 10 of Delhi School Education Act, 1973.”
