Sub: -Revision of pension of pre-2006 pensioners – delinking of revised pension from qualifying service of 33 years – amendment requested.
Ref: – Your OM No. 38/37/08-P&PW(A) dated 06.04.2016.
Please refer to your OM No. referred above. In Para-6 of the OM reads as follows:
“It has now been decided that the revised consolidated pension of pre-2006 pensioners shall not be Iowerthan 50% of the minimum of the pay in the pay Band and Grade Pay (wherever applicable) corresponding to the pre-revised pay scale as per fitment table without pro-rata reduction of pension even if they had qualifying service less than 33 years at the time of retirement.”
As per OM No. 38/86/03-P&PW (A) dated 29.08.2008 of Department of Pension and Pensioners welfare, in which the decision to implement the decision of the Govt. on 6th CPC recommendations was communicated, “pension should be paid at 50% of the average emoluments received during the last ten months, or the pay last drawn whichever is more beneficial to the retiring employee.”
The above clause of “50% of the last pay drawn” is missing in the OM No. dated 06.04.2016. when the benefit of this clause is extended to those pensioners who retired after 01.01.2006 (post 01.01.2006), it is not fair to deny the same benefit to pre-2006 pensioers, Moreover, the CAT, Principal Bench New Delhi, vide its common order on 01.11.2011, in OA 655/2010 and other 3 OAS, has directed to refix the pension of all pre-2006 retirees w.e.f 01.01.2006, based on the resolution dated 29.08.2008 of Department of pension & pensioner’s welfare. Though the above orders were challenged by the Govt, the SLP were dismissed in the Supreme Court.
The Resolution dated 29.08.2008 contains two decisions (1) delinking of the condition of 33 years and (2) calculation of pension as 50% of the last pay drawn or last ten months average pay whichever is more beneficial to the retiree. I request you to issue necessary modificatory orders to the OM dated 06.04.2016, so that the benefit of “50% of last pay drawn” will be extended to pre-2006 pensioners also.

What would be the pension as recommended by the secy.pension committee of 5th CPC formula of notional fixation. My last pay 14550 in 5th cpc scale 10000-325-15200 iretired on 31-12-2005 this was discussed in the last meeting with JCM staff side. Krishnamurthy.
From sepoy to subedar major the Rank to rank only around 500 but why shoud the last Rank Subedar major 20890 to Lt has goiven 30970 More then 9000 in basic ,is this the rank variation of basic pay is correct, Give the equal step by step variation as it is OFFICER t0 PBOR Why should the step varoation 9000/ ia it nit passality , why this the commission has given injustice, soldiers PBOR not a slea ves they sacrifies their lives morw to save the country,
Dear sirs, implementation of option 1 for pre 2006 retiree pensioners is getting inordinately delayed even after a Govt dept has found it feasible following the precedences of implementation after 5 and 6 CPC reports.
The implementation of option 1 for pre 2006 retiree pensioners/family pensioners is getting inordinately delayed.There was even a suggestion from Govt side showing the scheme feasible following 5 and 6 CPC precedents in implementation. Implementation of option 1 will be a good day for the pensioners like sanctioning of new allowances to serving employees
Dear Sirs,
It is not only of fixing 50% of the pay last drawn but also in view of the PM'srecent direction to reduce Govt's litigations, mentioning a Teacher case to make it to apply to all other teachers, GP4600 to S-12 be made to all and not be restricted to petitioners, be racked-up and request the Govt to respect the directions of the PM and pay G P 4600 to S-12 retirees and to revise the pension accordingly and pay arrears. Gen Sec BPS is kindly requested to peruse the matter with MoF and DoP&PW. H N Gopalaswamy.
In many cases the revised pension of pre 2006 pensioners is less than 50% of minimum of the pay scale of the ap0licable revised 7th CPC because of the application of 2.57 formula. Will the Govt. correct this as the Govt.is totally silenent to implement the option 1 & 3 to the pensioners'.
