Indian Forest Service (Probation) Amendment Rules, 2023

NOTIFICATION
New Delhi, the 23rd November, 2023

G.S.R. 863(E).—In exercise of the powers conferred by sub-section (1) of section 3 of the All-India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules, further to amend the Indian Forest Service (Probation) Rules, 1968, namely: –

1. (1) These rules may be called the Indian Forest Service (Probation) Amendment Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Forest Service (Probation) Rules, 1968, (hereinafter referred to as the “said rules’’), in rule 2,-

(A) for clause (a), following shall be substituted, namely: –

‘(a) “Academy” means the Indira Gandhi National Forest Academy, Dehradun or the Lal Bahadur Shastri National Academy of Administration or any other academy or institution that may be designated by the Central Government for the training of the Indian Forest Service Probationers’;

(B) for clause (d), the following shall be substituted, namely:-

(d) “Director” means the Director of the Academy’;

3. In the said rules, in rule 6,

(A) — in sub-rule (1), in clause (1), after the words “Lal Bahadur Shastri National Academy of
Administration” the words “or any other academy or institution” shall be inserted;

(B) insub-rule (1), after clause (11), following clause shall be inserted, namely:-
“(iii) ‘the state to which he is allocated and such period of training or part thereof during the training in the Indira Gandhi National Forest Academy”;

(C) the sub-rule (2) shall be omitted;

4. In the said rules, for rule 7, following shall be substituted, namely: –

“7. Record of the Training.– (1) A probationer under training shall attend such components of training curriculum, activities and exercises and undergo such evaluation through assessment and examination as the Director of Lal Bahadur Shastri National Academy of Administration and the Director of Indira Gandhi National Forest Academy or Director of any other academy or institution that may be designated by the Central Government, as the case may be, may from time to time direct.

(2) At the end of the period of training in the respective academies, the record of the training of each probationer, the Director of Lal Bahadur Shastri National Academy of Administration or Director of any other academy or institution that may be designated by the Central Government and the Director of Indira Gandhi National Forest Academy shall assess by awarding him such number of marks out of a maximum of 75 marks and 250 marks respectively, as he may, in each case, thinks fit.

(3) At the end of the training in the State, the record of training of each probationer shall be assessed by the officer designated by the State Government for this purpose by awarding the probationer such number of marks out of a maximum of 50 marks as he may, in each case, think fit.”

5. In the said rules, for rule 8, the following shall be substituted, namely:-

“8. Evaluation.- (1) Every probationer shall be required during the period of training to undergo such evaluation through assessments and examination, to be conducted by the Director as may be prescribed by the Central Government and in accordance with such procedures or any regulations as the Central Government may, in consultation with the State Governments and the Commission from time to time make:

Provided that no probationer in the service shall, during the period of training at the Indira Gandhi National Forest Academy, Dehradun, appear in either the Civil Services Examination, or in any other examination for appointment to the Central or State Service by open competitive examination.”;

6. In the said rules, for rule 9, the following shall be substituted, namely: –

“9. Failure to complete training components or undergo evaluations in certain circumstances.-Where a probationer is prevented by sickness or other causes over which he has no control from completing any components of training along with the assessment and examination for evaluation thereof, the Central Government may allow him to complete such component with the next batch of training or in a special component or examination etc. which the Director may hold for the purpose, or may exempt him from such component or examination etc. in full or part.”;

7. In the said rules, for rule 10, the following shall be substituted, namely: –

10. Failure in evaluation.- Where a probationer fails in the evaluation in component of training in the regulations framed under rule 8, the Central Government may permit him to undergo for re-evaluation in components in which he failed:

Provided that the marks awarded to a probationer on such re-evaluation shall not be taken into account in determining his seniority.”;

8. In the said rules, in rule 11, for the marginal heading and sub-rule (1), the following shall be substituted, namely: –

11. Inter-se seniority of Probationers.– (1) The Central Government shall prepare a list of all probationers who are appointed to the Service on the results of same competitive examination or who are assigned to a training batch or to a year of allotment as determined by the Central Government which shall be arranged in order of merit, determined on the basis of the marks obtained by each probationer, calculated in the manner specified below, namely:-

(a) full aggregate marks in the competitive examination;

(b) full aggregate marks in the evaluation in the training conducted by the Indira Gandhi National Forest Academy under the Indian Forest Service (Probationers’ Training and Evaluation) Rules, 2023;

(c) aggregate marks in the evaluation in the ‘Foundation Course’ training in the Lal Bahadur Shastri National Academy of Administration or any other academy or institution that may be designated by the Central Government, proportionated such that the weightage of marks in the Lal Bahadur Shastri National Academy of Administration or any other academy or institution that may be designated by the Central Government, for the final evaluation of merit for inter-se seniority is ten per cent of the sum of marks in the competitive examination, Indira Gandhi National Forest Academy and Lal Bahadur Shastri National Academy of Administration or any other academy or institution that may be designated by the Central Government:

Provided that in determining such order of merit no account shall be taken of marks awarded to a probationer in any subject in which he has failed to satisfy the Director:

Provided further that if two or more probationers have secured equal number of marks in the aggregate, their order of merit shall be the order of their dates of birth.

Explanation– In the case of probationers exempted under proviso to rule 6 from undergoing training at the Academy, the marks obtained in the Final Diploma Course Examination or in any other Institution recognised by the Central Government as equivalent thereto passed by them before their appointment to the State Forest Service shall be transformed in the ratio that the total aggregate marks of the Diploma Course Examination, or an examination recognised as equivalent thereto, passed by them bears to the aggregate marks in the examination referred to in rule 8 and the maximum marks referred to in sub-rule 2 of rule 7 and in such cases, the marks obtained by probationers covered by this explanation in any component of training in which they were re-evaluated shall be excluded in terms of the proviso to rule 10;

9. In the said rules, in rule 12, in sub-rule(1), after the words “Lal Bahadur Shastri National Academy of Administration”, the words, “or any other academy or institution that may be designated by the Central Government” shall be inserted;

10. In the said rules, in rule 14 A, in sub-rule (1), in clause(a), after the words “Mussoorie”, the words, “or any other academy or institution that may be designated by the Central Government” shall be inserted.
