Subject: Prior Intimation – Agitation Programme for Conversion of NPS to OPS and Constitution of 08th CPC.

Respected Sir,

With due regards, it is submitted that as part of our ongoing efforts to address the concerns of our members, the National Executive Committee of BPMS recently convened a meeting on 16 & 17 December at MSF Estate Ichapur (W.B.). During this meeting, a decision was taken to conduct two agitation programmes to address critical issues affecting government employees.

Agitation Programme Details:

Objective:

  • Demand the constitution of the 08th Central Pay Commission (CPC) for government employees.
  • Demand the conversion of NPS to OPS for those 7354 employees who are recruited in Ordnance & Ordnance Equipment Factories on or after 01.01.2004 against the vacancies sanctioned by Min of Defence vide File No. 1640/D(QA)/2002, dated 20.05.2003 for direct recruitment.

Activities:

  • Slogan Shouting, Gate Meetings, Dharna, Mass Demonstration.
  • A memorandum regarding the conversion of NPS to OPS will be submitted to your esteemed office on 10.01.2024, through the respective Head of Establishments of Ordnance & Ordnance Equipment Factories.
  • A detailed memorandum outlining the concerns and demands regarding the constitution of the 08th CPC will be submitted to the Finance Minister, Govt of India, on 19.01.2023, through the Head of Establishments of all the Defence Installations.

We understand the significance of these matters and the impact they have on the lives of our fellow employees. Our intent is to seek your support and cooperation in addressing these issues for the well-being and financial security of the affected personnel.

Your attention and consideration of these matters are highly appreciated. We look forward to a positive response and remain at your disposal for any further information or discussion.

    Kumar Sir,

    I think there is some mis-understanding.

    According to 5th CPC, the pay scale at S-19 is “10000-325-15200”.

    As I mentioned pay scale “3050-75-3950-80-4590”, this is at S-5.

    I think, you have mentioned this from 4th CPC.

    Respected Mam,

    I submit the following –
    1) I gave option of pay fixation in 7th CPC w.e.f. 01/01/2016 AND they gave option of pay fixation in 7th CPC w.e.f. 01/07/2016
    2) On 31.12.2005, my basic pay was Rs.3575/- AND their basic pay was also Rs. 3575/-
    3) On 31.12.2015, my basic pay was 10500+4200(Grade Pay) AND their basic pay was 10120+2400(Grade Pay)
    4) On 01.01.2006, my basic pay was Rs.6650+1900 (6th CPC) AND their basic pay was also Rs.6650+1900 (6th CPC)
    5) On 01.07.2006, my basic pay was Rs.6910+1900 AND their basic pay was also Rs.6910+1900
    6) On 01.01.2016, my basic pay was Rs.38700 (7th CPC) AND their basic pay was also Rs.10120+2400 (6th CPC) (they opted 7th CPC w.e.f. 01/07/2016)
    7) On 01.07.2016, my basic pay was Rs.39900/- AND their basic pay was also Rs.39900/- in 7th CPC

    Please Mam, help me in getting my rightful rights

    • Your case is perfectly related to Pay Anomaly as you are senior and your pay shouldn’t be lower than your junior. Please represent accordingly.

        Respected Mam, please suggest under which rule or section of office memorandum issued by government of India, have I to represent to my office? So that my representation may be considered in positive manner. Please guide me.

    Respected Sir,

    I want your good guidance in my case.

    My basic pay is less than my junior’s. The officials including myself were initially appointed to the post of Grade-IV (DASS) and the pay of all these officials was fixed at minimum stage of Rs. 3050/- in the pay scale 3050-75-3950-80-4590. As on today, the basic pay is as under:-

    1 Sh. Rajesh Kumar ——————-Rs. 49000/-
    2 Sh. Ajay Pal————————–Rs. 50500/-
    3 Sh. Jagbir Singh———————Rs. 50500/-
    4 Sh. Deepak Kumar Shaw————Rs. 50500/-

    These officials including myself initially were recruited through Staff Selection Commission and joined in Govt. of NCT of Delhi to the post of GRADE-IV . Seniority No. in GRADE-IV (DASS) and Date of joining in service are given below

    1 Sh. Rajesh Kumar———-13830———-22/07/1998
    2 Sh. Ajay Pal—————–14154———-01/09/1998
    3 Sh. Jagbir Singh————14332———-02/07/1998
    4 Sh. Deepak Kumar Shaw—14551———-14/12/1998

    Thereafter, all these were promoted to the post of GRADE-III vide order no. 178 dated 07.07.2008 with immediate effect.

    In the year 2015, I was granted Non Functional Selection Grade w.e.f. 01.07.2015 on the basis of my seniority number in the Seniority List of Grade-III

    In the year 2016, these three officials were also granted Non Functional Selection Grade w.e.f. 01.07.2016 on the basis of their seniority number in the seniority list of Grade-III

    Thereafter, all officials including myself were promoted to the post of GRADE-II vide order dated 14.09.2021 with immediate effect.

    Sir, what have I to do and under which rule position. Please Sir, give me the guidance.

    • Please check their option of pay fixation in 7th CPC and pay on 31.12.2005 & 31.12.2015 for clear picture of Pay anomaly. Also compare the pay on 01.01.2006, 01.07.2006, 01.01.2016 & 01.07.2016.

          I think the juniors of you all they came with higher pay/direct recruitments with there pay production rules of transfer. Because in the 6th CPC Basic Pay plus Grade Pay increment of 3% as fixation from 1-1-2006 to all employees.
          Also you can cheek their date of joining and date of birth because they may retire before you.

            Sir,

            I clarify that all of us are direct recruitments and were recruited through open competition through Staff Selection Commission.

            Further, before coming into service, all of us were unemployed. There is no case of pay protection.

            It is true that others are elder than me and they will retire from service before me about 3 to 4 years before.

            But, sir, it is not right that an elder employee gets more pay than younger employee. I think, it will be right a senior employee get more pay than junior employee.

            It may also be right that a junior employee get equal pay to his senior but should not get more pay.

            Check in the 5th CPC there is no pay scales as you mentioned, in S-19 3000-125-3625, 3000-100-3500-125-4500 & 3000-100-3500-5000. You got stagnation increment fixation with 6th CPC minimum basic pay.
            If your statements are true, wait for your service verification for 25 years completion before retirement, at that all of your records will scrutinizes by your Pay & Accounts Office.
            Since you are elder to all of them you may retire before, so you can represent through proper channel of your Head of Department to the PAO.
