REVIEW PETITIONS ON NPS

Will the PRIME MINISTER be pleased to refer to answers to UQ428 and 425 given in Rajya Sabha on Feb 4 and July 22, 2021 respectively and state:
(a) whether Supreme Court has dismissed various SLPs and Review Petitions during the year 2021 and has allowed the Central Government officials under NPS, the benefits of old pension scheme whose advertisements were issued before 01/01/2004 and results declared and joining occurred after 31112/2003;
(b) if so, the details thereof, case-wise;
(c) the details of cases where Government has issued orders to revert these officials after / judgments of Supreme Court, case-wise; and
(d) by when general order for all similar cases on above lines would be issued?
ANSWER
MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (DR. JITENDRA SINGH)
(a) to (c): Hon’ble Supreme Court has dismissed some of SLPs filed by Union of India during the year 2021 against the orders of Hon’ble High Court of Delhi allowing benefit of old pension scheme to those Government servants whose selection process was completed after 01.01.2004. Details of cases is enclosed at Annexure-A
(d): National Pension System (NPS) was introduced for Central Government employees by a Notification of Ministry of Finance (Department of Economic Affairs) dated 22nd December, 2003. NPS is mandatory for all new recruits to the Central Government service from 1st January, 2004 (except the armed forces).
In view of the specific prov1s1ons of the Notification dated 22.12.2003, the date of advertisement for the vacancies is not considered relevant for determining the eligibility for coverage under the Old Pension Scheme or the National Pension System.

क्या प्रधानमंत्री 4 फरवरी और 22 जुलाई, 2021 को राज्य सभा में अतारांकित प्रश्न: 428, 425 के दिये गए उत्तर को देखेंगे और यह बताने की कृपा करेंगे कि:
(क) क्या उच्चतम न्यायालय ने वर्ष 2021 के दौरान विभिन्न एसएलपी और समीक्षा याचिकाओं को खारिज कर दिया है और राष्ट्रीय पेंशन योजना के तहत केंद्र सरकार के उन अधिकारियों को पुरानी पेंशन योजना का लाभ दिया है जिनके विज्ञापन 01/01/2004 से पहले जारी किए गए थे और परिणाम की घोषणा और उनकी नियुक्ति 31/12/2003 के बाद हुई थी;
(ख) यदि हां, तो तत्संबंधी मामला-वार ब्यौरा क्या है ;
(ग) उन मामलों का ब्यौरा क्या है जहां सरकार ने उच्चतम न्यायाल्रय के निर्णयों के बाद इन अधिकारियों को पुरानी पेंशन योजना में वापस लाने के आदेश जारी किए हैं ; और
(घ) उपर्युक्त तर्ज पर सभी समान मामलों के लिए सामान्य आदेश कब तक जारी किए जाएंगे?

(क) से (ग): माननीय उच्चतम न््यायातल्रय ने वर्ष 2021 के दौरान, उन सरकारी कर्मचारियों को, जिनकी चयन प्रक्रिया 01.01.2004 के बाद पूरी हुई थी, पुरानी पेंशन योजना का लाभ देने की अनुमति देने वाले माननीय दिल्ली उच्च न्यायालय के आदेशों के विरुद्ध भारत संघ द्वारा दायर कुछ एसएलपी को खारिज कर दिया है।। मामलों का ब्यौरा अनुबंध-क में संलग्न है।
(घ) वित्त मंत्रालय (आर्थिक कार्य विभाग) के दिनांक 22 दिसम्बर, 2003 की अधिसूचना द्वारा राष्ट्रीय पेंशन प्रणाली(एनपीएस) को लागू किया गया था। दिनांक 01.01.2004 से केंद्रीय सरकार की सेवा में हुई सभी नई भर्तियों (सशस्त्र बलों को छोड़कर) के लिए राष्ट्रीय पेंशन प्रणाली(एनपीएस) अनिवार्य है। दिनांक 22.12.2003 की अधिसूचना के विशिष्ट उपबंधों को ध्यान में रखते हुए, पुरानी पेंशन योजना या राष्ट्रीय पेंशन प्रणाली के तहत कवर किए जाने के लिए, पात्रता निर्धारित करने के लिए रिक्तियों के लिए विज्ञापन की तारीख को प्रासंगिक नहीं माना जाता है।
